1. Definitions

For the purposes of these Terms:

  • "Service" refers to the Minarete website and Deck Generator application.
  • "User Content" means any photos, text, or data you upload to the Service.
  • "Generated Content" means the Lotería cards and decks created by our AI.
  • "Free Preview" refers to low-resolution or watermarked versions of Generated Content.
  • "Paid Download" refers to the high-resolution, unwatermarked PDF files purchased by the user.

2. Acceptance of Terms

By accessing or using Minarete, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. You must be at least 13 years old to use this Service.

3. Payment, Refunds, and Licensing

3.1 Pricing & Payment

Services are offered on a pay-per-product basis. Pricing is clearly displayed at checkout. All fees are in USD unless otherwise stated. Payment processing is handled by third-party providers (Stripe).

3.2 License to Use

  • Free Preview: You are granted a limited, non-exclusive license for personal evaluation only. Commercial use is prohibited.
  • Paid Download: Upon payment, you are granted a perpetual, non-exclusive, worldwide license to print, display, and use the Generated Content for personal or commercial purposes.

3.3 Refund Policy

Due to the digital nature of our products, all sales are final once the high-resolution file has been downloaded or made available. However, if you experience technical issues preventing you from accessing your purchase, please contact support@elminarete.com for a replacement or refund at our discretion.

4. User Content & Rights

You retain implementation ownership of your User Content. By uploading content, you grant Minarete a worldwide, royalty-free license to use, reproduce, and process your User Content solely for the purpose of generating your Lotería decks and providing the Service.

You represent and warrant that you own or have the necessary rights to all User Content you upload, and that its use does not violate any third-party rights.

5. Prohibited Uses

You agree not to use the Service to:

  • Upload content that is illegal, pornographic, promoting hate speech, or otherwise harmful.
  • Harass, abuse, or harm another person or group.
  • Infringe upon the intellectual property or privacy rights of others.
  • Upload viruses, malware, or any other malicious code.
  • Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to terminate accounts and delete content that violates these policies without refund.

6. Intellectual Property (Minarete)

The "Minarete" name, logo, and the underlying AI generation technology are the intellectual property of Minarete. You may not reverse engineer, decompile, or copy the Service's underlying code or proprietary styles.

7. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

If you wish to terminate your account, you may simply discontinue using the Service.

8. Disclaimer & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". MINARETE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.

IN NO EVENT SHALL MINARETE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in San Francisco, California, except that either party may assert claims in small claims court if valid. You agree to waive any right to participate in a class action lawsuit.
